Payment
All designs must be paid for in advance of starting any project. Upon request, a payment schedule may be arranged and contracted. Due to the work involved in the design process, unfortunately, refunds cannot and will not be given. Please, be sure that you are 100% ready to go through with your design project prior to payment.
Time Frame
We appreciate that you are excited to get your new site up and running so my team works as diligently as possible through an efficient process of both deign and development. Each project is unique and therefore, a timeline will be provided in formal written contract. Branding projects normally take approximately 30 days- web development projects can take between 30-90 days depending on project scope.
Communication
In order for you and Creative Mystics to successfully complete your desired design, it is imperative that the communication is solid. Due to the complexity of each project, we must complete each one in a timely matter. Please, be sure to respond to emails in a timely fashion. If there is no communication after 90 days, your project will be null and void and there will be no refund issued.
Changes
During the initial design process, revisions will be unlimited. After project completion any change will be done at an hourly charge of $75 per hour.
Permissions
By rendering Creative Mystics’ design services, you are allowing us to use your design as an image in our portfolio at Creative Mystics.
Privacy
In most cases, the use of your log in information is required to complete tasks such as WordPress installation. We will never share this information with anyone outside of the project team.
Copyrights & Liability
Artwork Release
If any native files such as InDesign, Photoshop, or Illustrator are requested, there will be an artwork release fee of 25% the total design (including images use for the development of design). The original artwork remains copyrighted to Creative Mystics, unless previously agreed in writing.
Copyrights
You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the artwork are either owned by yourself, or that you have expressed written permission to use them.Grant of any reproduction rights to the Client is conditioned upon receipt of payment in full. Creative Mystics shall reserve all rights not expressly granted. The designs, original artwork, electronic proofs, print-ready PDFs, and all other files created by Creative Mystics are protected by Federal Copyright Law and may not be reproduced, manipulated, re-worked for other purposes, edited, submitted to any contests, or shared in any manner without our explicitly written permission.
We retain the right to make reproductions for our portfolio, samples, self-promotion, professional competition and review, and website even if the artwork release has been purchased. Associated designs and artwork can include commercial print design/business card/stationery design/signage/desktop icons/mobile phone and other portable device application icons and imagery. Any supporting artwork and designs required by this project can be used as indicated by Jichél Stewart and Creative Mystics for personal and professional reasons.
Disputes
Creative Mystics operates in Los Angeles County, California in the United States of America. The laws of the State of California will govern the legal notices and conditions of use without giving effect to any principles or conflicts of laws.
Creative Mystics retains the right to take legal action if this Agreement is violated, and in such case, if Creative Mystics prevails, the Client is solely responsible for any and all mediation, arbitration, and legal fees incurred by Creative Mystics.
If a party in any manner violated or threatened to violate Creative Mystics’ intellectual property rights, Creative Mystics may seek injunctive or other appropriate relief in any state or federal court in the state of California, and the Client consents to exclusive jurisdiction and venue in such courts, notwithstanding any provision in this Agreement which can be construed to the contrary.
Any dispute relating to the products and/or services Client purchases through Creative Mystics or relating to a breach of this Agreement shall be resolved in the city of Long Beach, CA in the United States of America.
